TACTICS FOR HOMEOWNER'S ASSOCIATIONS TO OBTAIN UNPAID FEES

Many homeowner's associations, either rightly or wrongly, view rental homes within their association as a potential problem. Those same associations also view owners within the association who fail to pay their monthly/quarterly association fees as a problem. A sometimes under-utilized law can help a homeowner's association use one potential problem to fix the other. In a situation where a home is occupied by a renter and is behind on its association fees, Florida law permits the association to direct the renter to pay their rent directly to the association until the fees are paid off. The renter is in no worse a position because they are simply paying their current rental rate to the association. The law also protects the renters from eviction as long as the renters pay their rent to the association. The association clearly benefits because they receive at least a portion of what they are owed.
